Ares (com.ares.fit) for Android

These Terms govern your use of Ares. By downloading, accessing, or using Ares you agree to these Terms and the Privacy Policy. If you do not agree, do not use the app.

1. Who provides Ares

Ares is provided by Pugal G, a private individual (software developer and student) in Karnataka, India (PIN 560099). There is no company registration.

As an individual student project, features, availability, and support are more limited than a large commercial product.

2. Eligibility and age

You must:

• be at least 13 years old (or older if your country requires it), and
• have the legal capacity to agree to these Terms where required.

If you are under 13, do not create a cloud profile or use the app in a way that stores your personal data with me.

You are responsible for complying with the laws of the place where you use Ares.

3. The service

Ares is a fitness and activity tracking application. It includes:

• GPS-based activity recording (walk, run, cycle, hike),
• maps and route history,
• daily step-related features and estimates via Health Connect when you grant read access to steps (Ares does not write to Health Connect),
• session step counts during tracked workouts from device sensors when permitted,
• optional body metrics and fitness estimates,
• guest or offline use on your device,
• passphrase-protected local backup of local training data,
• optional route sharing via the Android share sheet,
• optional Ares Pro features via Google Play (including Friends).

Ares Pro currently includes Friends (connect by Ares ID and rank daily steps), Body Activation and body targets, Stats, and Multi-route map views, plus related cloud behaviour described in the Privacy Policy.

Features can be added, changed, or removed at any time.

4. Accounts

4.1 Google Sign-In

Cloud accounts use Google Sign-In. You must keep your Google account secure. I am not responsible for unauthorised access that results from your Google account being compromised.

4.2 Guest / offline mode

Guest mode stores data on your device only. Guest data is lost if you uninstall the app, clear storage, or lose the device. Linking a Google account is refused if that Google account already has Ares cloud data.

4.3 Sessions

Signing in on another device may end your session on this one.

Logout ends the session on this device and clears local sign-in data for that session.

4.4 Your responsibilities

You agree to provide accurate profile information you choose to enter (including date of birth for age checks) and not to impersonate others or misuse another person's Google account or Ares ID.

5. Acceptable use

You agree not to:

• try to access another user's account or private data without permission,
• harass others through Friends or misuse Ares IDs,
• overload, disrupt, or attack the service,
• bypass security or paid-feature controls,
• falsify activity or sensor data to commit fraud or mislead others,
• use Ares for unlawful, harmful, or abusive purposes,
• scrape the service, or
• upload malware or unlawful content.

There is no public social feed or messaging product. Friends is opt-in: you connect by Ares ID. Profiles use a letter mark, not photos.

I suspend or terminate access if I reasonably believe you violated these Terms or create risk for the service or other users.

6. Your content

You retain rights in the activity data and profile fields you create.

You grant me a limited, worldwide, non-exclusive licence to host, store, process, and display that content only as needed to operate Ares (including backups, sync, and Friends ranking for people you connect with).

If you share content outside Ares (for example via the share sheet), you are responsible for that sharing. Connecting Friends means you choose to share the display name and daily step totals described in the Privacy Policy with those users.

Map tiles, OpenStreetMap data, and third-party libraries remain under their own licences—see Software Licenses.

7. Ares Pro (subscriptions)

7.1 Billing

Optional paid features (Ares Pro) are sold through Google Play Billing as monthly and yearly subscriptions.

Prices are shown in Google Play at purchase. New accounts receive a 14-day complimentary Pro trial. After the trial ends, Pro features require an active Google Play subscription unless the account is sponsored.

7.2 How entitlement works

Purchases are verified with Google. Subscription information is stored so the app can unlock Pro features. Payment cards are handled by Google, not by me.

Some users receive complimentary Pro access granted by me without a Play purchase.

7.3 Renewal, cancellation, refunds

Subscriptions renew through Google Play until you cancel in the Play Store (Manage subscriptions). Refunds follow Google Play's refund policies and any mandatory consumer law that applies to you. Ares does not operate a separate refund portal.

7.4 Account deletion vs subscription

Deleting your Ares account removes Ares's copy of entitlement data for that account but does not cancel the Google Play subscription. Cancel in Google Play to stop renewal and billing.

7.5 Offline Pro

Pro features may continue offline for a limited time after your last successful check. After access ends, a network connection is required to restore it.

7.6 Cloud retention for free vs Pro

Free-tier cloud routes are retained for 90 days after sync and then removed from the cloud. Routes synced while Pro is active are exempt from that free-tier expiry. Local device copies are not automatically deleted when cloud copies expire.

8. Fitness disclaimer (important)

• Calories, energy figures, guidance notes, Body Activation outputs, and similar outputs are estimates produced by algorithms and are often inaccurate.
• GPS distance, elevation, maps, and pace depend on satellites, sensors, and third-party map and elevation services. They are often inaccurate or incomplete.
• Step counts differ from other apps or wearables.
• Body metrics you enter can be wrong or outdated.
• Do not use Ares to diagnose, treat, cure, or prevent any disease or condition.
• Talk to a qualified health professional before starting or changing exercise, especially if you have a medical condition, are pregnant, or have concerns.
• Physical activity involves risk of injury. You use Ares and exercise at your own risk.

9. Third-party services

Ares relies on third parties, including:

• Google (Sign-In, Play Billing, updates, and location services),
• a cloud host for signed-in accounts,
• map providers,
• an elevation provider.

Their terms and privacy policies apply to their services. Outages or changes at those providers can affect Ares.

10. Intellectual property

Ares's name, branding, app code, and original materials are owned by Pugal G or its licensors. You receive a personal, non-transferable licence to use the app as offered through Google Play, not ownership of the software.

Feedback

If you send ideas or feedback, you grant me permission to use them to improve Ares without obligation to you, to the extent permitted by law.

11. Availability and support

I try to keep Ares working, but I do not guarantee uninterrupted or error-free service. As an individual developer and student, support is provided on a reasonable-efforts basis via contact.apx.dev@gmail.com and is subject to delay.

12. Termination

You can stop using Ares at any time and can delete your account in the app (Profile → Delete account).

I can stop offering Ares or particular features. If the service shuts down, I will try to give reasonable notice when practical, but I cannot promise continued hosting forever.

13. No warranties — use at your own risk

To the maximum extent permitted by law:

• Ares is provided "as is" and "as available", with no warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement.
• I do not warrant that estimates, GPS, maps, steps, sync, notifications, or Pro entitlement will be correct, complete, or available at all times.
• You use Ares entirely at your own risk.

14. No responsibility for loss or damage (limitation of liability)

To the maximum extent permitted by applicable law, Pugal G (the individual operator) and Ares are not responsible and not liable for any loss, damage, cost, or claim of any kind arising out of or related to your use of—or inability to use—Ares, including but not limited to:

• loss of data, routes, steps, profile, or settings (on your device or in the cloud),
• loss of money, profits, subscriptions, refunds, or Google Play billing issues,
• device damage, battery drain, or performance problems,
• wrong location, wrong distance, wrong elevation, wrong calories, or wrong guidance,
• personal injury or property damage while exercising or navigating,
• unauthorised access to your Google account or device,
• bugs, crashes, security incidents, or third-party outages,
• any indirect, incidental, special, consequential, exemplary, or punitive damages,
• any other cause or consequence connected with Ares.

If, despite the above, any liability is found that cannot be fully excluded under mandatory law, then total liability of Pugal G and Ares for all claims relating to Ares is limited to the greater of:

1. the amount you paid for Ares Pro through Google Play in the 12 months before the claim, or
2. INR 5,000 (five thousand Indian Rupees).

Some laws do not allow certain exclusions. Where that is true, these limits apply only as far as the law allows. Nothing in these Terms excludes liability that cannot legally be excluded (for example certain liability for proven intentional wrongdoing or gross negligence, or non-waivable consumer rights).

15. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Pugal G and Ares against claims, losses, and costs arising from your misuse of Ares or your violation of these Terms (for example unlawful use or attempts to attack the service).

16. Governing law and disputes

These Terms are governed by the laws of India, with particular regard to Karnataka, without regard to conflict-of-law rules that would apply another law—except that mandatory consumer protections of your country of residence still apply.

Disputes are subject to the courts having jurisdiction in Karnataka, India, subject to any mandatory consumer venue rules that apply to you.

17. Changes

These Terms are updated from time to time. The Effective date changes when they do. If you continue using Ares after the new Terms take effect, you accept them where the law allows. If you do not agree, stop using the app and delete your account.
